What is a ‘right to repair’
A ‘right to repair’ is the ability of consumers to have their products repaired at a competitive price using a repairer of their choice.
In conducting it’s inquiry, the Productivity Commission identified a range of policies that could be implemented/amended including changes to consumer and competition law, intellectual property protections, product labelling, and environmental and resource management, in order to give rise to a ‘right to repair’ in Australia.
Legislation has not yet been passed and the proposed changes to policy have not yet been implemented.
Current ‘rights’ relating to repair
As it stands, consumers currently have rights to have their products repaired, replaced or refunded, and rights to access spare parts and repair facilities, under consumer guarantees in the Australian Consumer Law.
The proposed introduction of ‘right to repair’ legislation extends on this current position and is particularly applicable to the agricultural industry. For instance, the Report proposes that the Australian Government should require suppliers of agricultural machinery to provide access to certain repair supplies.
